James Andrew Abernathy, 42, claimed a German shepherd dog from an animal shelter and named her "Marie" after the girlfriend, Deputy District Attorney Heather Brown said Monday. But after a loud fight with his girlfriend on Jan. 27, 2002, Abernathy beat his dog with a metal golf driver, rammed a stake through the dog's heart and cut off its head, she said. Superior Court Judge Kaz Makino found Abernathy guilty after less than two hours of testimony. Two neighbors testified that a barefoot and disheveled Abernathy showed up on their doorstep caked in dried blood and said, "I need help." Normally, a conviction of cruelty to animals carries a maximum penalty of three years in prison. But Abernathy could be sentenced to life because he has been convicted twice on two counts of assault with a deadly weapon in Los Angeles County in 1986 |
