California SBC 861 Breed laws
California Senate Bill SB861 allows local communities to pass breed
specific laws. It is on the brink of passing. http://www.akc.org/news/index.cfm?article_id=2604 The following is forwarded from a fellow agility competitor: Several of you asked me at the TRACS trial to provide the phone number of the governor's poll on whether he should veto or pass a bill now before him that would allow governmental agencies to ban ownership of certain breeds or types of dogs within their borders. Right now the Hayden Bill, which was passed 15 years ago, forbids this type of discrimination against breeds and requires laws address a dogs actions, not his ancestors or appearance. The phone number to add your opinion of whether or not to veto the bill is 916-445-2841, wait for the prompts and hit 2 then 6 then 2 if you want the bill vetoed. If you support the hit 1. You will not get a person, this is only a poll. It is frequently difficult to get through during the day, so I suggest calling during non business hours. Call frequently and on as many different phone numbers as possible. Many, many municipalities already have legislation drafted to forbid ownership of breeds of dogs they deem dangerous. They are only waiting for this bill to pass to put them into effect. Most of them provide no or little recourse if your dog is identified as having the ancestors of any breed they deem to be dangerous. There is no requirement for accountability or training on the part of the people making the life or death decisions on our dogs. If you have a neighbor who doesn't like dogs, they now have a new thing to complain about. If you think this is only about pit bulls, you are wrong. Some of the breeds and breed mixes listed in various communities are Dobies, GSD, Rotts, any dogs over a certain weight (40-50# being popular), some just list body characteristics, such as broad head, stocky, etc., a description most cattle dogs fall under. Some include any brachycephalic type dogs, such as boxers, mastiffs, etc. One includes a list of 30 characteristics and if your dog has over x number of them, it is included. I know a Chihuahua that met enough of the characteristics. The bottom line is they could add any breed they wanted once they passed the basic legislation, so if you have an elected official who doesn't like dogs, you are in trouble. They don't have to prove your dog is what they say it is, you have to prove it is not that breed and in most cases the decision cannot be appealed and your dog is gone! Go on line and see what is happening in Denver since they passed this type of legislation. Feel free to cross post this to any one or any list you feel would be interested.
